The petition hearing was conducted in the High Court as scheduled on March 11, 2024 by the judge responsible for handling the company's case. The company requested that the petition hearing be adjourned for five weeks to allow the company enough time to prepare detailed proposals and process the documents and agreements required for a potential share offering to raise funds to fully repay the petitioner. As a result, the High Court has directed that the adjournment petition hearing will be heard on April 15, 2024 before a judge responsible for handling the company's case.
The High Court also issued an approval order for the transfer of shares to the company during the same petition hearing on March 11, 2024. Therefore, from the time of the winding-up petition (i.e. June 12, 2023), the transfer of the company's paid-up shares will not be deemed invalid as a result of the winding-up petition under section 182 of the Companies (Liquidation and Miscellaneous Provisions) Ordinance, Chapter 32 of the Laws of Hong Kong.
