Apart from the above Suits, there is another claim filed by the former director, CKC against WRSB in the
Industrial Court for constructive dismissal. CKC is one of the Defendants in the Suit filed by WRSB
referred to above. The allegation of constructive dismissal is premised on the Civil Suit filed against him
by WRSB. The Industrial Court has fixed the hearing on 23 to 25 June 2025.
On 18 December 2025, the Company and WRSB were served with a Writ of Summons and Statement of
Claim dated 10 October 2025 (New SGSB Suit) wherein SGSB has taken action against the following
parties:

D4. Datuk Lim Nyuk Sang @ Freddy Lim
D5. Chong Tzu Khen
D6. Director, Environment Protection Department, Sabah
D7. Director, Jabatan Tanah dan Ukur, Sabah.
D8. Director, Jabatan Mineral Dan Geosains, Sabah.
D9. The Government of the State of Sabah
SGSB is seeking, among other things, the following reliefs:
a) A declaration that the Sub-Lease Agreement dated 15 October 2015 between SGSB and WRSB is
terminated due to WRSB’s breach;
b) A declaration that the Memorandum of Agreement dated 13 July 2017 and other related agreements
and/or undertakings and/or documents that related to the Sub-Lease Agreement is terminated due to
WRSB’s breach;
c) WRSB deliver vacant possession of the Sub-Lease Land;
d) A permanent injunction restraining WRSB and its agents from entering, occupying or conducting
mining activities on the Main Lease Land
e) A declaration that the EIA approval on 14 March 2017 is exclusively for SGSB and an injunction
preventing WRSB from using or relying on the said EIA.
f) Damages against WRSB for breach of contract in the sum of RM500,000,000 or to be assessed;
g) Damages against WRSB for negligence, nuisance and trespass in the sum of RM40,000,000 or to be
assessed;
h) Damages against D1 – D5 for conspiracy to injure to be assessed;
i) D1 – D5 to account for all profits derived from alleged unlawful mining and sale of minerals between
31 October 2023 to 07 April 2024 and a payment of all sums allegedly due;
j) Alternatively, damages for conversion to be assessed;
k) Aggravated and exemplary damages in the sum of RM20,000,000 or to be assessed;
l) Costs of RM3,000,000.
